Lystr Technologies, Inc. (“Lystr”) respects the privacy of its users (“user” or “you”). This Privacy Policy explains how Lystr collects, uses, and discloses information with respect to your access to and use of our services through our website (the “Website”), mobile applications (“Apps”), and Lystr device ("Device"). It also is intended to explain your rights in relation to that information.This Privacy Policy does not apply to other third-party websites, applications, or services. 

Information we collect

We collect “Non-Personal Information” and “Personal Information.”  Non-Personal Information includes information that cannot be used to personally identify you, such as anonymous usage data, general demographic information we may collect, referring/exit pages and URLs, platform types, preferences you submit and preferences that are generated based on the data you submit and number of clicks.  Personal Information includes your email address and any other information you provide us when registering for and using our services. In order to register for and use our services you will need to provide Personal Information. By registering, you are authorizing us to collect, store, and use Personal Information you provide in accordance with this Privacy Policy.

In an effort to improve the quality of our service, we track information provided to us by your browser or by our software applications when you view or use our services, such as the website you came from (known as the “referring URL”), the type of browser you use, the device from which you connected to our Website, the time and date of access, and other information that does not personally identify you.  

Online technologies such as cookies and web beacons are used by Lystr and our other service providers.  These technologies are used in analyzing trends, administering the Website, tracking users’ movements through the Website, and to gather demographic information about our user base as a whole. For example, Cookies are sent to a user’s browser from our servers and are stored on the user’s computer hard drive.  Sending a cookie to a user’s browser enables us to collect Non-Personal information about that user and keep a record of the user’s preferences when utilizing our services, both on an individual and aggregate basis. Users can control the use of cookies at the individual browser level. If you reject cookies, you may still use our Website, but your ability to use some features may be limited. We may receive reports from our analytics or other service providers based on the use of these technologies by our analytics or other service providers on an aggregated basis.

As is true of most websites, we gather certain information automatically and store it in log files.  This information may include internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and/or clickstream data. We may combine this automatically collected information with other information we collect about you. We do this to improve the services we offer you.

We partner with third party analytics providers, (e.g. Google Analytics), to manage our advertising on other websites and to improve our services. Our partners may use technologies such as cookies to gather information about your activities on our Website and other websites in order to provide you advertising based upon your browsing activities and interests.  If you wish to not have this information used for the purpose of serving interest-based ads, you may opt out of receiving targeted ads.  

We collect the information that is transmitted by your Lystr device, such as the barcode of a product you scan or the voice recording that you make. We collect this in order to make your shopping list. Your Lystr device will also collect and/or send certain technical information about its operation, such as your WiFi network, so that the Device can communicate with our servers.

We do not knowingly collect personally identifiable information from children. If we learn that we have collected personally identifiable information from someone under 13, we will take steps to delete such information from our files as soon as possible.

We also collect certain information that your mobile device sends when you use our services. This includes data like a device identifier, user settings, the operating system, as well as information about your use of our services. If you enable location services through your mobile device, we will collect your location and/or use various technologies to determine your location, such as sensor data from your device. You can enable or disable location services through your mobile device settings. We also may collect your location-based information for the purpose of locating a retail store within your area.  We will only share this information with our retail partners. We may also use location information for aggregate reporting on an anonymous basis and to improve our service.

We may send push notifications to keep the Lystr mobile application up-to-date and improve our services. If you no longer wish to receive these notifications, you may turn them off either via your mobile device or through our mobile application.

How We Use Information

Personal Information: In general, the Personal Information you provide to us is used to enable our services, like making your grocery list. We do not sell, trade, rent or otherwise share for marketing purposes your Personal Information with third parties without your consent. We do share Personal Information with vendors who are performing services for us or for our customers. Those vendors use your Personal Information only at our direction and in accordance with our Privacy Policy.

Non-Personal Information: In general, we use Non-Personal Information to help us improve our services.  We also aggregate Non-Personal Information in order to track trends and analyze use patterns on our Website.  This Privacy Policy does not limit in any way our use or disclosure of Non-Personal Information and we reserve the right to use and disclose such Non-Personal Information to our partners, and other third parties at our discretion.

In the event we undergo a business transaction such as a merger, acquisition by another company, or sale of all or a portion of our assets, your Personal Information may be among the assets transferred.  You acknowledge and consent that such transfers may occur and are permitted by this Privacy Policy, and that any acquirer of our assets may continue to process your Personal Information as set forth in this Privacy Policy.  If our information practices change at any time in the future, we will post the policy changes so that you may opt out of the new information practices.  We suggest that you check our Website periodically if you are concerned about how your information is used.

We use the information we collect for the purposes described below:

  • to provide our services,
  • to process and complete any transactions you request,
  • to respond to inquiries and send messages regarding our services,
  • to monitor and analyze usage and trends of our services,
  • to personalize and improve our services,
  • to provide you with relevant products and advertisements, and
  • for any other purpose for which the information was collected.

How We Protect Your Information
We implement security measures designed to protect your information from unauthorized access.  Your account is protected by your account password and we urge you to take steps to keep your personal information safe by not disclosing your password.  We further protect your information from potential security breaches by implementing certain technological security measures.  While we employ administrative, physical and electronic measures designed to protect your information from unauthorized access, no security measures are perfect or impenetrable and no method of data transmission can be guaranteed against any interception or other type of misuse. In the event that your personal information is compromised as a result of a breach of security, we will promptly notify you if your personal information has been compromised, as required by applicable law.

Your Rights Regarding the User of Your Personal Information

You have the right at any time to prevent us from contacting you for marketing purposes.  When we send a communication to a user, the user can opt out of further promotional communications by following the unsubscribe instructions provided in each email.  Please note that notwithstanding the promotional preferences you indicate by either unsubscribing, we may continue to send you administrative emails including, for example, periodic updates to our Privacy Policy.

You can access and modify the information you provide us through your account. If you completely delete all your information, your account will become deactivated and you will not be able to access our services through your account. If you would like us to update or delete personal information from our system, please contact us with your request by emailing us at or by writing us at our address below. We will respond to your request within 30 days.

We will retain your information for as long as your account is not deactivated or as needed to provide you services.  We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Links To Other Websites And Services

As part of our services, we may provide links to or compatibility with other websites or applications.  If you submit personal information to any of those websites, your information is governed by their privacy policies. We encourage you to understand the privacy policy of any website you visit. 

Sharing Information With Third Parties
We will not share your personal information, except as described below:

  • when you instruct us to do so, such as when you share your shopping list or when we notify you that the information you provide will be shared in a particular manner and you provide such information,
  • with our service providers who are working with us in connection with the operation of our services (like to process a payment). These providers may have access to your information but only to the extent necessary to perform services on our behalf and are obligated not to disclose that information or use it for any other purposes,
  • as required by law or legal process (such as a subpoena, warrant, or court order), if we have to respond to a lawful request from legal authorities to disclose such information, or when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request, to enforce or apply this Privacy Policy, our terms of use or our other policies, and
  • in connection with an acquisition, sale of our assets, or other situation where user information would be transferred to a third party as one of our business assets (but the use of that information will remain subject to this Privacy Policy, unless you agree to that information being subject to a different or new privacy policy).

We may also share information about our users in anonymous form with third parties for usage analytics (to help us better understand who is using our services and how), to improve the relevancy of the ads you see on our services and for industry analysis, demographic profiling, research, and other similar purposes.

Changes To Our Privacy Policy

Any information we collect is subject to the Privacy Policy in effect at the time. We may modify our Privacy Policy from time-to-time. If we make any material changes to our Privacy Policy, we will notify you of such changes by posting them on our website, through our services, or by sending you a notification prior to the change becoming effective. By continuing to access or use our services after those changes become effective, you are agreeing to be bound by the revised policy.
